An Obama Judge Just Ordered Legal Status for 985,000 Illegals Who Used an App

An Obama-appointed federal judge just ruled that the Trump administration can’t revoke the parole status of nearly a million migrants who waltzed into the country through a Biden-era phone app. Judge Allison Burroughs — who owes her lifetime appointment to Barack Obama — decided that 985,000 people who used the CBP One app to schedule their illegal entry like a dinner reservation deserve to keep their “legal” status.

Here’s how this scam worked. The Biden administration launched the CBP One app in 2023, which let migrants from all over the world book appointments at the southern border like they were reserving a table at Olive Garden. Show up at the port of entry, flash your phone, and congratulations — you’re “paroled” into the United States for up to two years. Over 900,000 people used this system. That’s not immigration policy. That’s a concierge service for border jumpers.

The whole thing was an end-run around actual immigration law. Traditional legal immigration requires applications, background checks, waiting periods, and — here’s the crazy part — a legitimate reason to be in the country. The CBP One app replaced all of that with a smartphone and a Wi-Fi connection. The Biden administration essentially created a parallel immigration system that bypassed every law Congress ever passed on the subject.

When the Trump administration did the obvious thing and terminated these parole statuses — correctly arguing that Biden never had the authority to create this program in the first place — Judge Burroughs stepped in to save the day. Her ruling stated that the government took action “not in accordance with law” when it revoked the parole without following proper procedures. She also declared that “the regulations do not give the agency unfettered discretion to terminate parole.”

Read that again. A judge appointed by the man who built this open-borders machine is now telling the current president he can’t undo it because the paperwork wasn’t filed correctly. The same judicial system that looked the other way while Biden invented an entire immigration program out of thin air is suddenly very concerned about procedural compliance.

The Justice Department is expected to appeal, and here’s where this gets interesting.

The Trump legal team has been waiting for exactly this kind of fight. Every time an Obama or Biden judge blocks an immigration enforcement action, it creates a path to the appellate courts — and eventually to a Supreme Court that has shown zero patience for administrative overreach. The Biden administration created the CBP One program without congressional authorization. No law passed by Congress says “let people book immigration appointments on their phones.” The executive branch just invented it.

That means when this case reaches a higher court, the question isn’t whether Trump followed the right procedure to end the program. The question is whether the program should have existed in the first place. And if the Supreme Court rules that Biden’s CBP One app exceeded executive authority — which it clearly did — then the parole status of all 985,000 people becomes legally indefensible regardless of how Trump went about revoking it.

Judge Burroughs just handed the Trump administration a legal vehicle to get a definitive ruling on executive immigration authority from the Supreme Court. The same judges who think they’re protecting these migrants may end up creating the precedent that buries every future attempt to run immigration policy through executive fiat.

Mark my words — the appeal of this ruling will move fast, and when it lands at the Supreme Court, the Biden administration’s entire phone-app immigration system gets dismantled from the foundation up. Judge Burroughs won’t be ordering anything then.

In the meantime, 985,000 people who entered the country through a smartphone app are being told by a federal judge that their status is secure. The Trump administration is being told by the same judge that the rules matter — rules that didn’t seem to matter at all when Biden was handing out parole like Halloween candy.

The legal system, ladies and gentlemen. It only discovers procedural requirements when a Republican is in the White House.
